The Center for New York City Neighborhoods, Inc. (the “Center”) is a New York not-for-profit that promotes and protects affordable homeownership in New York so that middle- and working-class families are able to build strong, thriving communities. Working with public and private partners, the Center and its affiliates meet and support the diverse needs of homeowners throughout New York State by offering free, high-quality direct services, support of community based housing counselors, policy research and advocacy, and affordable lending products.

Sustainable Neighborhoods LLC, a CDFI and subsidiary of the Center (“SN”), has been selected by New York State’s Homes and Community Renewal (“HCR”) to administer the New York State Homeowner Assistance Fund (“NYS HAF”), using resources allocated to New York under the federal American Rescue Plan Act of 2021 to deliver financial support and services to homeowners affected by COVID-19.

Position Summary

This is a one-year project-based position, subject to renewal or adjustment depending on the needs of the NYS HAF program and/or the needs of the organization’s small but growing legal department.

This is not a direct-representation position. In this setting, your client is the organization/program.

The Center seeks a Project Attorney to provide support for the New York State Homeowner Assistance Fund Program, a high-impact effort to urgently help homeowners affected by the pandemic who are in danger of losing their homes. The Project Attorney will:

  • Work with our NYS HAF Appeals Team to develop and implement an ongoing system through which the program can provide timely decisions on appeals, and to address any necessary policy/case management changes arising out of the appeals system;
  • Provide advice and counsel on the substance and application of NYS HAF program policies to internal staff and stakeholders.
  • Assist in the resolution of escalated case matters; and
  • Support the team responsible for servicer coordination/communications, ideally utilizing a background in foreclosure law/loss mitigation matters.

Responsibilities may include but are not limited to:

  • Develop and implement an ongoing appeals triage system in partnership with the HAF Appeals Team; Decision appeals in accordance with program policy; In coordination with our partners, suggest/draft updates to program policy where appropriate based on appeal trends/policy application;
  • Draft program policies and guidance documents, and advise and counsel on applicability of existing NYS HAF program policies and procedures; Maintain updated written policy documents across the project for both internal and external consumption; Coordinate with program partners to analyze, assess, and update existing policies on an going basis as necessary, including as part of the HAF Policy Committee comprised of Center and HCR staff;
  • Identify systemic consumer protection legal and regulatory issues that will improve outcomes for low-to-moderate income homeowners affected by the pandemic, collaborate on advocacy strategies to improve policy and improve compliance;
  • Assist with the resolution of escalated case matters, including those involving loss mitigation in the NYS HAF program;
  • Advise, counsel, and guide Center staff, contractors, and program partners on homeowner loss mitigation laws, regulations, and guidance including CFPB Regulation X, TILA/RESPA, NYS banking law, federal agency loss mitigation rules;
  • Manage relationships with additional key partners and stakeholders, including state government contacts, contractors, nonprofit partners;
  • Proactively identify performance trends, ensuring ongoing reporting and engagement of staff on performance successes, proactively implementing mid-course corrections on internal program processes, as needed; and
  • Other duties reasonably related to the position may be required.

Skills & Qualifications

  • JD required
  • At least three years legal practice experience, including at a law firm, public interest, in-house, or public sector environment (candidates with greater experience are encouraged to apply)
  • A demonstrated interest in/experience with working on program and/or project policy issues
  • Detailed knowledge of residential mortgage loan servicing regulations and COVID-19 loss mitigation guidelines applicable to residential mortgage servicers is strongly preferred
  • Broad consumer protection law knowledge is a plus
  • Demonstrated competencies in legal research, legal writing, business writing, project planning and implementation, problem solving, judgment and decision-making
  • Excellent communication and interpersonal skills
  • Good presentation skills, including the ability to deal effectively with diverse and interdisciplinary staff
  • Complete confidentiality and discretion
  • Passionate about promoting affordable homeownership and an equitable New York
  • Deep understanding of and commitment to ensuring diversity, equity and inclusion

Salary

We offer a competitive salary and a comprehensive benefits package. Expected salary range is $80-90k depending on experience.
