Job description: Minimum Qualifications MINIMUM QUALIFICATIONS:

Juris Doctor from an accredited law school, an active member of the New York State Bar and at least six years of relevant legal experience.

PREFERRED QUALIFICATIONS:

  • Five years of Labor Law experience
  • 5 years of administrative litigation experience, including representing clients and writing decisions.
  • Ability to initiate and maintain relationships across a diverse set of stakeholders

Duties Description STANDARD DUTIES:

Under the direction of the Chair and Counsel, the Administrative Law Judge/Hearing Officer will handle a variety of tasks that may include holding virtual conferences, presiding over contested hearings, managing electronic and/or paper case files from hearings, drafting and editing decisions and presenting before the Board, among other tasks. Hearings are held primarily in a virtual setting but can also be held in person at various locations across the state.

The candidate must have experience and proficiency in the marking, identification and introduction of evidence and must be able to make decisions in real time during the hearing on the relevancy of proposed exhibits to the wide variety of Labor Law topics which may be at issue. The candidate must be able to both manage their own technology needs in order to conduct the hearing, but also must be capable of managing the myriad technology issues which may come up at a hearing involving litigants, witnesses, court reporters and interpreters. The candidate may also be called upon to engage with the Office of the Attorney General regarding cases over which they presided that become the subject of further post-hearing litigation. The hearings held by the Industrial Board of Appeals concern orders or determinations issued by the Department of Labor to private employers for numerous types of Labor Law violations involving work conditions such as hours of work and wages owed, or by the Department’s Public Employment Safety and Health division (“PESH”), which enforces workplace safety standards against public employers in New York.
